I have been practising law for 30 years. During this period I have helped over 2000 clients get the results they deserved. However, even trained attorneys can get caught up in the moment of passion and prosecution and forget to have client promises documented in a written contract. This is what happened to me in 1998, 14 years ago.

In some matters attorney compensation is hard to determine until the full facts are known. In addition, some attorney compensation can include a "success fee". When an attorney focuses on getting the best results and not on documenting every agreement affecting his or her compensation in writing disputes often result. In my case, I have no one to blame but myself.

In 2011, after years of appeals, I was disciplined by the State Bar for failing to document my right to additional compensation in 1998, 14 years ago. Instead of having a new trial, I accepted responsibility and stipulated to a one year stayed suspension, three years of probation with a 90-day actual suspension.

That suspension ended in May 2011. In late 2010 I was diagnosed with cancer. My treatments ended in June 2011. This is my only act of any discipline by the State Bar in 30 years.
In 1998, several brothers who owned and operated 15 Mexican restaurants in Arizona and California were arrested on federal felony charges related to their restaurants and indicted in the US District Court of Arizona. I was one of several lawyers who represented the brothers in what became an unexpectedly complex case, i.e. 65 bankers boxes of statements and evidence and 20 boxes of video interviews. In time, I became the lead coordinating and contact attorney. All of the evidence and its review took place in my office in Los Angeles. The case was the largest case in US history involving the illegal hire of over 200 illegal aliens.

I agreed to represent one of the brothers for $10,000, before knowing that it involved 65 bankers boxes of statements and evidence and 20 boxes of video interviews or that it was the largest case in US history regarding the illegal hire of illegal aliens. My agrement did contain a provision for the possibility of more fees if required. I handled the client’s cases for four years, made numerous trips to Mexico, San Diego, appearing in US District Court in San Diego, Eloy, Florence and Phoenix, appearing in the US District Court of Arizona.

I attended numerous hearings in Phoenix, meetings with co-counsel, government prosecutors and government agents of the Criminal Fraud Division of the Dept of Justice and government prosecutors and agents of the Criminal Division of the IRS in Phoenix. Additional travel included Washington, D.C., to meet
with the top attorney at the Department of Justice. I coordinated and was selected by the other attorneys
to handle all post conviction debrief sessions for all of the brothers.

My client was facing over 85 months in federal prison. I obtained reduced sentences, 13 months, for my client and a brother. However, because the charges also involved wilful failure to pay income taxes, after a third superseding indictment was filed, money laundering, and consipracy, crimes of moral turpitude, all of the brothers who were non-resident aliens, except one, faced removal proceedings. After losing the removal proceeding, they waived their right to appeal and selected immediate deportation.

The federal judge in the criminal case complimented my work. Even the prosecuting Assistant United States Attorney for the District of Arizona complimented my hard and tireless work for my client and as the lead attorney for the joint defense later on.

When I submitted billings in excess of $10,000, for services that were rendered over many years, they were disputed. Although every other attorney that played a lesser role in the defense received fees from $35,000 to $100,000, and for just handling one matter, I was unable to convince a new judge in a court trial in Phoenix that I had properly documented an agreement with my client for the payment of fees in excess of $10,000 for my 4 years of work. Even the former Assistant United States Attorney for the District of Arizona testified on my behalf. One of the other attorneys, Thomas Mesereau, also testified on my behalf about the quality and quantity of work I performed. Later a 6 year partnership was formed with Attorney Mesereau, during which he represented Michael Jackson and Robert Blake. That partnership ended in 2006.

In 30 years of practising law this is my only act of discipline of any kind on my record. I accept responsibility for it. Some days were long, some nights were sleepless and agonizing, but when the morning came, I was reminded that I never lost my faith in the goodness of people or my belief in my God that all would be well. I often read the Serenity prayer and the Desiderata poem cited below.

There is no legal obligation for me to disclose this single act discipline unless asked. Many attorneys would not want to draw attention to their prior discipline, but I thought you should know. I believe you have a right to know. I love the practice of law and helping people solve their legal problems. I can admit to lessons learned.

many persons strive for high ideals;
and everywhere life is full of heroism.

Be yourself.
Especially, do not feign affection.
Neither be critical about love; for in the face of
all aridity and disenchantment it is as perennial as the grass.

Take kindly the counsel of the years, gracefully
surrendering the things of youth.
Nurture strength of spirit to shield you in sudden
misfortune. But do not distress yourself with imaginings.
Many fears are born of fatigue and loneliness.
Beyond a wholesome discipline, be gentle with yourself.

You are a child of the universe, no less than the trees
and the stars;
you have a right to be here.
And whether or not it is clear to you, no doubt the
universe is unfolding as it should.

Therefore be at peace with God, whatever you
conceive Him to be, and whatever your labors and aspirations,
in the noisy confusion of life keep peace with your soul.
With all its sham, drudgery and broken dreams, it is still a
beautiful world. Be careful. Strive to be happy.
